Terms of Use.

The terms that govern your use of the Buildemics platform and your participation in our programmes. Please read them together with our Privacy Policy and Refund and Cancellation Policy.

Welcome to Buildemics. These Terms of Use (“Terms”) govern your access to and use of www.buildemics.com, the Buildemics platform, applications, dashboards, digital resources and related services (collectively, the “Platform”), and your enrolment in or participation in any programme, mentorship, research, educational, career-development or related service offered by Buildemics (collectively, the “Services”).

By accessing, registering on, enrolling in or using the Platform or Services, you agree to these Terms and the policies incorporated into them. If you do not agree, you must not use the Platform or Services.

1.About Buildemics

The Services are provided by PASSIONETT ADVISORS PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, bearing CIN: U70200MP2024PTC070400, having its registered office at 180, Rachna Nagar, Near Kamlesh Medical, Govindpura, Huzur, Bhopal – 462023, Madhya Pradesh, India (“Buildemics”, “we”, “us” or “our”).

Buildemics provides research mentorship, educational guidance, research-oriented programmes, skill development, career guidance, project and publication-related support, community activities and other related Services as may be offered from time to time.

These Terms shall be read together with the Privacy Policy, Refund and Cancellation Policy, Academic Integrity and AI Usage Policy, Parent/Guardian Consent and applicable Programme-specific terms.

2.Definitions

For these Terms:

“Programme” means any programme, course, mentorship, research or educational service offered by Buildemics.

“Student” means the person participating in a Programme.

“Parent/Guardian” means the parent or lawful guardian responsible for a Student who is a minor.

“Mentor” means an individual engaged or assigned by Buildemics to provide mentorship or other Services.

“Session” means a scheduled interaction between a Student and Mentor or Buildemics representative as part of a Programme.

“Completed Session” means a Session that has been conducted for the scheduled duration or is treated as completed because of the Student's non-attendance or late cancellation in accordance with these Terms or the applicable Programme terms.

“Credit” means a non-cash benefit or replacement entitlement that Buildemics may provide, at its discretion or under the applicable Programme terms, in place of a Session, Service or other benefit.

3.Eligibility and Parent/Guardian consent

Users must provide accurate, complete and current information while using the Platform or enrolling in a Programme.

Where a Student is below 18 years of age, enrolment and use of paid Services must be undertaken with the consent and involvement of a Parent/Guardian. The Parent/Guardian shall be responsible for accepting these Terms on behalf of the Student and for ensuring the Student's compliance with applicable Programme requirements.

Buildemics may request information or documents reasonably necessary to verify identity, eligibility or Parent/Guardian consent.

4.Programmes and programme changes

The scope, duration, number of Sessions, Mentor, Deliverables, Fees, eligibility requirements and other terms of a Programme shall be communicated at or before enrolment.

Buildemics may reasonably change the schedule, Mentor, Session format, delivery method, Programme structure or other arrangements where necessary. Where a change materially affects an ongoing Programme, Buildemics may provide a reasonable alternative arrangement, replacement Session or Credit, where applicable.

A Mentor may be replaced where reasonably necessary due to availability, performance, scheduling, conflict of interest or other operational reasons.

Programme-specific terms shall apply where they provide additional or different requirements.

5.Registration and account security

Where registration is required, you must provide accurate information and keep your account details updated.

Account credentials are personal and must not be shared, transferred or misused. You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account.

You must promptly notify Buildemics if you suspect unauthorised access or use of your account.

Buildemics may suspend or restrict an account where reasonably necessary to protect the Platform, Users or its legitimate interests.

6.Fees, payment and taxes

Fees shall be as displayed or communicated at the time of enrolment and shall be payable through the payment methods made available by Buildemics.

You are responsible for providing accurate payment information and completing payments when due. Applicable taxes shall be charged in accordance with law.

If a payment fails, is reversed or remains unpaid, Buildemics may suspend or restrict access to the relevant Services until the outstanding amount is resolved.

Third-party payment gateways may be subject to their own terms and conditions.

7.Sessions, attendance and rescheduling

Sessions shall be conducted according to the applicable Programme schedule.

Requests for rescheduling or cancellation should be made in accordance with the applicable Programme terms and, where required, within the prescribed notice period.

A Student who fails to attend a scheduled Session or cancels without the required notice may have the Session treated as a Completed Session and may not be entitled to a replacement Session, refund or Credit, except where Buildemics determines otherwise in exceptional circumstances.

Buildemics may reschedule a Session where reasonably necessary due to Mentor availability, technical issues, emergencies or other circumstances beyond its reasonable control.

8.Cancellation, refunds and credits

Cancellation, withdrawal, refunds, replacement Sessions and Credits shall be governed by the applicable Refund and Cancellation Policy and Programme-specific terms.

Any refund shall be subject to the applicable eligibility conditions, deductions and timelines.

Credits, where offered, are not cash and may be subject to expiry, use restrictions or Programme-specific conditions.

Unless expressly stated otherwise, third-party charges, transaction fees or amounts already paid to external service providers may not be refundable.

9.User responsibilities and prohibited use

You agree to:

  • use the Platform and Services only for lawful purposes;
  • provide accurate information;
  • comply with these Terms and applicable policies;
  • respect Mentors, Students, employees and other Users;
  • maintain the confidentiality of your account and information; and
  • comply with applicable academic, research and ethical standards.

You must not:

  • impersonate another person or provide false information;
  • access another person's account or information without authorisation;
  • interfere with or compromise the Platform or its security;
  • introduce viruses, malware or harmful code;
  • copy, scrape, reproduce or commercially exploit Buildemics Materials without permission;
  • harass, threaten, abuse or discriminate against another person;
  • infringe the intellectual property, privacy or other rights of any person; or
  • use the Platform for any unlawful, fraudulent or unauthorised purpose.

10.Academic integrity, AI and research conduct

Students are responsible for the originality, accuracy and integrity of their academic and research work.

Plagiarism, fabrication, falsification, unauthorised copying, misrepresentation of authorship and other forms of academic misconduct are prohibited.

Use of artificial intelligence or other automated tools shall comply with the Academic Integrity and AI Usage Policy and the requirements of the relevant institution, publisher or academic body. Buildemics may require disclosure of material AI assistance where applicable.

Users must comply with applicable ethical, institutional and safety requirements for research. Users must not undertake unlawful, unsafe or unauthorised research activities through the Services.

Buildemics may refuse to support or discontinue any research activity that it reasonably considers unsafe, unlawful or inconsistent with applicable ethical requirements.

11.Mentor-Student conduct and safeguarding

Mentor-Student interactions shall ordinarily take place through approved Buildemics channels or Programme arrangements.

Mentors and Students must maintain professional and appropriate conduct. Users must not engage in harassment, inappropriate communication, exploitation or conduct that may compromise the safety or dignity of another person.

Private meetings or communications outside approved Programme arrangements should not be undertaken where prohibited by Buildemics or applicable safeguarding requirements.

Any safeguarding concern should be promptly reported to Buildemics through the grievance/contact mechanism.

12.Session recording and programme content

Where Sessions are recorded for quality, training, safety, academic or Programme administration purposes, recording shall be undertaken subject to applicable law, the Privacy Policy and any required consent.

Users must not independently record, reproduce, publish or distribute Sessions or Programme interactions without appropriate permission.

Buildemics may retain Programme records and recordings for the period reasonably required for the purposes described in its Privacy Policy and applicable law.

13.Intellectual property

All trademarks, logos, text, designs, software, Programme Materials, research resources, graphics and other content provided by Buildemics (“Buildemics Materials”) are owned by or licensed to Buildemics and are protected by applicable intellectual property laws.

Buildemics grants the User a limited, non-exclusive, non-transferable and revocable right to access and use Buildemics Materials solely for personal and permitted educational purposes.

You must not reproduce, distribute, sell, publish, modify, share or commercially exploit Buildemics Materials without prior written permission.

Students retain ownership of their original work, subject to any separate agreement, third-party rights and applicable Programme terms.

Buildemics shall not use identifiable Student Work, name, image, testimonial or other personal material for promotional purposes except with the consent required under applicable law.

14.Privacy and confidentiality

Personal information is collected, used, stored and processed in accordance with the Buildemics Privacy Policy and applicable law.

Where a Student is a minor, applicable Parent/Guardian consent and the requirements of the Privacy Policy shall apply.

Users shall maintain the confidentiality of non-public information received through the Services and shall not disclose or misuse confidential information belonging to Buildemics, Mentors, Students or third parties.

The confidentiality obligations shall not apply to information that is publicly available, independently developed, lawfully obtained from another source or required to be disclosed by law.

15.Third-party services and links

The Platform may contain links to or integrations with third-party websites, payment gateways, applications, publishers, institutions or other services.

Third-party services are independently operated and may be subject to their own terms and privacy policies. Buildemics does not control or guarantee such services and, to the extent permitted by law, shall not be responsible for their acts, omissions or content.

16.Disclaimer

The Platform and Services are provided on an “as is” and “as available” basis, to the extent permitted by law.

Buildemics shall make reasonable efforts to provide the Services as described but does not guarantee that the Platform will always be available, uninterrupted, secure or error-free.

Buildemics does not guarantee any particular academic, research, publication, admission, scholarship, employment, competition or career outcome.

Information and guidance provided through the Services are intended for educational and mentorship purposes and shall not be treated as a guarantee of any particular result.

17.Limitation of liability

To the maximum extent permitted by applicable law, Buildemics and its directors, officers, employees, Mentors and representatives shall not be liable for indirect, incidental, special, consequential or punitive losses arising from the use of the Platform or Services.

Buildemics shall not be responsible for losses arising from third-party decisions, third-party services, technical failures, unauthorised account access caused by the User, or the User's breach of these Terms.

To the extent permitted by law, Buildemics' aggregate liability arising from a particular Programme or Service shall not exceed the Fees actually paid for that Programme or Service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18.Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Buildemics, PASSIONETT ADVISORS PRIVATE LIMITED, its directors, officers, employees, Mentors and representatives against claims, losses, damages, liabilities and reasonable expenses arising from:

  1. your breach of these Terms or applicable policies;
  2. your misuse of the Platform or Services;
  3. your violation of applicable law or third-party rights; or
  4. inaccurate, unauthorised or unlawful information or material provided by you.

19.Suspension and termination

Buildemics may suspend or terminate access to the Platform or Services for material breach of these Terms, misuse of the Platform, non-payment, violation of applicable policies or where reasonably necessary to protect the Platform, Users or third parties.

Where reasonably practicable, Buildemics may provide notice and an opportunity to remedy a breach before suspension or termination.

Upon termination, the User shall cease using the Platform and Buildemics Materials, except where continued access is expressly permitted.

Termination shall not affect rights or obligations accrued before termination, including payment, confidentiality, intellectual property, indemnity and liability provisions.

20.Force majeure

Buildemics shall not be liable for delay, interruption or failure to perform its obligations to the extent caused by circumstances beyond its reasonable control, including natural disasters, epidemics, governmental action, changes in law, war, civil unrest, strikes, power or internet failures, technical disruptions or third-party service failures.

Buildemics may, where reasonably practicable, reschedule affected Sessions, extend a Programme, provide an alternative arrangement or applicable Credit.

21.Governing law and dispute resolution

These Terms shall be governed by the laws of India.

The parties shall first attempt to resolve disputes through good-faith discussions. Subject to applicable law, courts at Bhopal, Madhya Pradesh shall have jurisdiction over disputes arising from these Terms.

Nothing in this Clause shall restrict any statutory right or remedy available to a User, Student or Parent/Guardian.

Buildemics shall endeavour to address grievances in accordance with applicable law.

23.General terms

These Terms, together with the Privacy Policy, Refund and Cancellation Policy, Academic Integrity and AI Usage Policy, Parent/Guardian Consent and applicable Programme-specific terms, constitute the agreement governing your use of the Platform and Services.

Buildemics may update these Terms from time to time by publishing the revised version on the Website. The updated Terms shall apply from the effective date stated therein, subject to applicable law.

If any provision is held invalid or unenforceable, the remaining provisions shall continue in effect.

No failure or delay by Buildemics in exercising any right under these Terms shall constitute a waiver of that right.

These Terms do not create a partnership, joint venture, employment, agency or other relationship between Buildemics and the User except as expressly agreed in writing.
